Official Rules for the Eagle River Nature Center 2019 Raffle

Raffle Prizes: The winner of all raffles prizes are responsible for all taxes (sales and W-2G other income prize winnings). All winners must provide proper identification when claiming prizes. If the winner elects not to accept a prize, no substitution or exchanges for cash or other goods will be provided.
Grand Prize: Five (5) acres of land, South Caribou Lake Lot 3, Block 7, Homer, courtesy of Friends of Eagle River Nature Center, Inc.
Description of Property:Lot 3 in Block 7 of Alaska State Land Survey No. 81-175, within portions of Tracts “A” and “G”, A.S.L.S. 80-155 and the W1/2 of Section 35, B.L.M. Tract “A”, Township 3 South, Range 11 West, Seward Meridian, containing 5.0 acres, more or less, according to the survey plat filed in Homer Recording District on March 5, 1982, as plat No. 82-20.
The winner is responsible for all taxes, title and registration fees. (2018 taxes for the property were $64). The land will be titled after winner signs the eligibility and liability release informing the winner’s liability for all of the applied taxes, license and registration fees. The winner must have proper identification when claiming the prize (a valid state driver’s license, passport or state ID). If the winner elects not to accept the prize, no substitution or exchange for cash or other goods will be provided. Friends of Eagle River Nature Center is not responsible for the prize’s quality nor shall it have any responsibility once the prize has been conveyed to the winner.
Eligibility. ALL ticket holders must meet the requirements according to Alaska Gaming Statutes to be eligible to participate and enter. To be eligible to win, entries must be completed and received by Friends of Eagle River Nature Center in the format designated below. Board members of Friends of Eagle River Nature Center and employees of Friends of Eagle River Nature Center are not eligible. Friends of Eagle River Nature Center reserves the right to disqualify any entrant for violation of these Official Rules, any applicable laws, or anyone who makes any misrepresentations relative to this drawing of chance.
Entry in Drawing. Participation in this drawing by chance shall be through ticket sales. Each ticket is $100. A maximum of 100 entries, which comply with these Official Rules, will be accepted, on a first come, first served basis. Persons may purchase unlimited number of tickets (max 100). Entries may not be resold and no refunds or replacements will be issued.
Cut-off/Maximum Entries. No entries will be accepted or distributed after October 5, 2019. If any of the 100 tickets still remain on October 5, 2019, then they will be available for purchase at the Nature Center's Annual Auction on October 5, 2019, between 5:30- 8:00pm at the AK Native Heritage Center.
Selection of and Notification to Winner. The winners will be selected at a random drawing in plain view with the actual ticket stubs by an impartial person or party.The drawing will take place in Anchorage, Alaska on October 5, 2019 approximately 9 p.m AK time at the Eagle River Nature Center’s Annual Auction at the AK Native Heritage Center. Entrants do not need to be present to win. The winner will be notified by certified email or telephone, according to the contact information provided to Friends of Eagle River Nature Center at the time of entry. The odds of winning the prize will depend on the number of entries. In the event a winner cannot be contacted, fails to respond within the required time frame, fails to otherwise qualify for the prize and/or declines the prize, an alternate winner will be selected. If not claimed within 14 days of notification, the winner designee will forfeit any rights to the prize and the same will be awarded to an alternate winner. The right to take possession of any prize through the winning entry is neither assignable nor transferable. PRIZE AWARDED IN ANCHORAGE, ALASKA on or before 12/31/19.
Drawing Procedure. One (1) tickets will be drawn randomly for the grand prize. This shall be final and binding in all respects.
Affidavit & Release. As a condition of being awarded the land, the winner designee shall be required to execute and deliver to Friends of Eagle River Nature Center a signed affidavit of eligibility, acceptance of these Official Rules and release of liability.
Use of Winner’s Name. In consideration for being awarded the land, the winner agrees and consents, without further authorization, compensation or remuneration of any kind, to the use of such person’s name in any and all advertising, promotions and other publicity in any media, worldwide, in perpetuity.
Taxes and Deductibility. Donations or ticket revenue made in connection with this drawing of chance are not tax deductible. All federal, state and local taxes associated with the receipt and use of the land and cabin, and vehicle and prizes are the sole responsibility of the winner. All federal, state and local taxes are based on the final actual retail value of the vehicle.

Governing Laws. This drawing by chance and these Official Rules will be governed, construed and interpreted under the laws of the State of Alaska. All applicable federal, state and local laws and regulations apply. Offer void where prohibited.
Contest Sponsor. This drawing by chance in a charity drawing held in compliance with the State of Alaska and is sponsored by Friends of Eagle River Nature Center, which is a qualified organization exempt from federal income tax pursuant 26 U.S.C. Section 501. Friends of Eagle River Nature Center holds a valid Alaska Gaming Permit #2231.
Dispute Resolution. Friends of Eagle River Nature Center shall resolve all disputes in its sole and absolute discretion.
General Release. Each entrant releases Friends of Eagle River Nature Center, participating sponsors and any of their respective affiliates, directors, officers, employees, agents and successors from any liability whatsoever, and waive any and all cause of action, for any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with or as a result of participation in this drawing by chance and if the winner, in acceptance, possession or use of the prize (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory.
